West Virginia Nondiscrimination in Involuntary Denial of Treatment Act

Virginia bills that would authorize the "involuntary denial of treatment" are proceeding through the Virginia legislature. Meanwhile, the West Virginia legislature is considering a bill that would do exactly the opposite. H.B. 4467, based on a model already enacted in Oklahoma and Idaho, provides in part that "if a person legally authorized to make health care decisions on behalf of a patient directs the provision of medical treatment or nutrition or hydration, the denial of which would, in reasonable medical judgment, be likely to result in or hasten the death of the patient, the patient's physician or health care facility may not deny provision of such treatment."
