Canada’s Supreme Court Rules to Permit Parallel Importation and Free Trade (CBC)

“Food giant Kraft Canada Inc. has lost its attempt to use copyright law to prevent a Quebec importer from selling its famous chocolate bars — Toblerone and Côte dOr. In an unusual case, Kraft had tried to restrict the other companys rights to distribute the European chocolate bars by copyrighting the logos on its wrappers — Toblerones bear in the mountain and Côte dOrs elephant. The Supreme Court
of Canada ruled 7-2 that Euro-Excellence Inc. did not violate copyright laws when it continued to distribute the chocolate after its contract with Kraft had expired….”
