What Are the Differences Between DUI and DWI?

While many people use these terms interchangeably, there is a distinct difference between DUI and DWI in the state of Texas. DUI, or Driving Under the Influence, refers to minor drivers who have any detectable amount of alcohol in their systems, whereas DWI, or Driving While Intoxicated, refers to an “intoxicated” person (either a minor or an adult) who is operating a motor vehicle in a public place. In order to be intoxicated under Texas law, you must either: ·         Not have the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of these substances, or any other substance into the body, OR ·         Have an alcohol concentration (blood alcohol content/BAC) of 0.08 or more.
