Supreme Court correctly applied the Doctrine of Collateral Estoppel to the hearing officer's determinations as to the reasons for the employee's terminationThe Appellate Division ruled that the New York State Department of Education's hearing officer's determination established that the reasons for the termination of Plaintiff's employment and that such reasons [1] were not pretextual, and [2] were motivated by age discrimination. The Hearing Officer further found that there was no evidence that Plaintiff "was targeted or discriminated against because of her personality or for any other reason." Moreover, the question of why the Plaintiff was not offered more remediation efforts was considered by the Hearing Officer, who attributed the reason to Plaintiff's resistance to such efforts.
