Regulatory Amendment Proposed to Ban Burning of Used Oil in Space Heaters

The Ministry of the Environment intends to ban the burning of used oil (i.e. waste-derived fuel) for the purposes of space heating.  As such, a proposed amendment to Regulation 347 under the Environmental Protection Act has been posted on the Environmental Bill of Rights for comment.  The draft regulatory amendment provides that the burning of used oil will be banned unless an air approval authorizing such activity was issued prior to January 11, 2007.  The proposed ban does not apply to facilities in Northern Ontario or agricultural operations that burn their own used oil and would give companies with existing air approvals to burn waste oil until June 1, 2009 to decide upon replacement heating and make appropriate arrangements.  Click http://www.ene.gov.on.ca/envregistry/029109er.htm for a link to the Environmental Bill of Rights posting, which also contains a link to the draft regulatory amendment.


Written submissions on the proposed regulatory amendment will be received until February 10, 2007.
