Kentucky Cardiologist Sentenced to 60 Months for Health Care Fraud and False Statements Relating to Implanting Medically Unnecessary Stents and Falsifying Degree of Stenosis in Medical Records

Credit: The Daily IndependentOn May 2, 2019, well-known Kentucky cardiologist Dr. Richard E. Paulus was sentenced, by U.S. District Court Judge David L. Bunning, to serve 60 months in federal prison for health care fraud and false statements almost three years after his trial and an acquittal by the court that got reversed on appeal. In October 2016, a federal jury convicted Dr. Paulus of one count of health care fraud and ten counts of making false statements relating to health care matters, after hearing evidence that he exaggerated what he saw on patients' angiograms and then defrauded Medicare, Medicaid, and private insurers, by implanting medically unnecessary stents in his patients and falsifying the degree of stenosis in their medical records. The case was started by a complaint to the Board about the number of stent surgeries performed and their medical necessity.After the trial, the district court granted Dr. Paulus’s motion for an acquittal.  The…

Zillow Claims Trade Secrets Protection Over Machine Learning Algorithms; Sues Compass for Theft

Many companies are currently racing to adopt artificial intelligence and machine learning to automate and augment various aspects of their businesses. Those who have succeeded and have gained the first-mover advantage are facing the challenge of keeping key employees who have helped them build the technology because these individuals become a primary target for poaching by competitors. From Arthur Andersen to Rohrmoos Venture: New leading case for attorney fee awards in Texas

THE LODESTAR COMES TO ALL LONE STAR STATE COURTS Last month the Texas Supreme Court handed down an important decision on attorney’s fees in a case involving a dispute over a commercial lease. Rohrmoos Venture v. UTSW DVA Healthcare, LLP, No. 16-0006 (Tex. Apr. 26, 2019).While the resolution of the case pivots on issues of contract law in the leasing context, the lengthy portion of the opinion addressing the matter of attorneys fees [see cut & pasted below] will have much broader impact across a wide array of practice areas. This is because the Texas Supreme Court blessed and adopted the Lodestar approach in reversing an award of more than $800,000 in attorney’s in the case for insufficient supporting evidence in the record. The Lodestar approach has long been in use in the federal courts when fees may be awarded under a fee-shifting statute (such as the civil rights act), but was limited in Texas state court mostly to employment discrimination cases…
