Offshore Platform Worker Sues after Crane Accident-Injury

Work on an offshore platform is full of work-related dangers, but very often, as maritime lawyers see, injuries occur even during routine activities. An offshore platform worker has sued a crane operator after the serious injuries he sustained in a crane accident on the platform. The victim was working for Ocean Chef as a catering hand. On the day of the accident, he was being transported in a crane, where the crane smashed against the platform. He sustained serious injuries, and is seeking damages for physical and emotional pain and suffering, fringe benefits, physical disability, medical expenses, punitive damages, court costs and loss of wages. The lawsuit has been filed against the operator of the crane, Seatrax Louisiana Inc. in federal court in New Orleans. As a offshore injury lawyer with a special focus on Jones Act cases, I see my share of offshore platform workers who are confused about their status under the Act. The Jones Act provides for substantial compensation for injured workers who qualify as Jones Act seamen. Defining who qualifies as a seaman under the Jones Act can be challenging for any worker. For a maritime employer, being able to show that the seaman does not qualify as a Jones Act seaman is crucial to winning their case and minimizing their damages. There are seemingly simple, but complex details about the kind of work that the worker performs on the platform, and the kind of vessel that the platform qualifies as, that can establish you as a seaman, or remove you from the purview of the Jones Act. That's why it's important that you consult with a maritime attorney before you file an injury claim.
