New Ninth Circuit Case on International Legal Assistance (MLAT)

Wow, today is a civil procedure day at the Ninth Circuit. First, it issued a decision which only a first year law student would love on "minimum contacts" with a State to subject out of state defendants to the State's court system. Second, is a case on the Mutual Legal Assistance Treaty (MLAT) with Russia. The case is United States v. Global Fishing, Inc. and can be downloaded here. In short, it relates to the United States' power to assist with a foreign country's criminal prosecution by issuing subpoenae against United States entities. Opinion is long, but if you are dealing with such matters, it is a very good read. The court found authority for the United States government to assist Russia in this fashion.
