This order was signed yesterday by Judge Neal Biggers, the senior status federal judge who will preside over the Scruggs trial. It allows defense attorneys to discover affidavits used to get warrants to intercept wire communications and also to receive a disc of the intercepted communications themselves. Doesnt mean these will become public, however. Defense counsel, very early in this case, made a motion to discover the prosecutors evidence. Note that the order on its face appears to apply only to wire communications and not to recordings that might have been made via a microphone on someones body. Those who know more about criminal procedure than I do may be able to tell me further about the significance of the order.
