Final Exit Network Loses 1st Amendment Challenge to Minnesota Assisted Suicide Law

In April 2018, Final Exit Network and two of its exit guides filed a federal lawsuit seeking a declaratory injunction against the Minnesota Attorney General and the Dakota County and Rice County Attorneys. FEN argued that Minnesota Statute 609.215 is unconstitutional on its face to the extent it makes a crime of First Amendment‐protected speech in the absence of any physical assistance. This week, the U.S. District Court for the District of Minnesota granted all the defendants' motions to dismiss. Notably, the court did not reach the constitutional merits, instead basing the decision on a variety of procedural grounds.Judge Nancy Brasel
