A shipyard worker was seriously injured in an accident near Chula Vista harbor in California over the weekend. According to Signs on San Diego, the man was working with a crew on disassembling a 124-foot-long barge at the Marine Group Boat Works shipyard. At some point, a beam that the man believed was still attached to the barge, fell on his head and face. He suffered serious facial lacerations, and injured his trachea. Fire crews transferred to the man to the University of California San Diego Medical Center, where he has now been placed in a medically induced coma. His condition is reported to be critical. According to police, there was no foul play involved in this incident. The man was wearing a hard hat at the time, but that obviously could not protect him from facial and neck injuries. There is little information about the man's work status at the time of the accident, but shipyard workers may come under the purview of the Longshore and Harbor Workers' Compensation Act. The Act includes stevedores, longshoremen, dockworkers and other workers who may not be eligible for seaman status under the Jones Act. However, lack of Jones Act seaman status does not mean that these workers do not have protection in the event of a work place accident in a harbor, shipyard or any other environment. These workers are eligible for benefits as laid out under the LHWCA. If you are an injured longshoreman, dockworker, shipyard worker, or any other kind of worker who does not qualify as a Jones Act seaman, then chances are very high that you qualify under the LHWCA.
